His last known Prof. Narrative Version: The following incident involved an assault between Mary Smith and Thomas Stevens. Mary and John Smith are married and reside at 55 Main St., Peterborough, ON. Mary Smith has a history of depression and anxiety. When not on her prescribed medications, Mary Smith can become aggressive. At the time of the assault, Mary Smith was not taking her medications. Stevens resides next door to Mary Smith at 57 Main St., Peterborough, ON. with his partner, Jesse Raymond. The assault stems from Mary Smith's claim that the laneway between their dwelling homes is her property and that Stevens does not have right of access. On Saturday, January 1, 2023, at 1:30pm, Tom Stevens was pulling a large dumpster on wheels along the laneway between his home and the Smith residence. At this time, he was approached by Mary Smith who pushed the dumpster and yelled at Stevens to put it on his own driveway. She then began to hit Stevens multiple times over the head with a newspaper she had in her hand. She claimed that, “This is my drive, not yours.” John Smith attempted to intervene, telling his wife to “Stop it.” When this failed, he put his arm around Mary Smith’s neck and pulled her away from Stevens and then released her. Immediately after being let go, Mary Smith continued her assault on Stevens by striking him several more times in the head with her newspaper and kicking him once in the leg. This continued for several more seconds with John Smith continually urging Mary Smith to stop. Despite his pleas, Mary Smith continued her barrage of strikes to Steven's head with her newspaper while intermittently pushing the dumpster closer to the road. During the assault, Mary Smith told Stevens, “I don’t like you” and “You've got no right of way here.” Towards the end of the assault, Mary Smith pushed the dumpster even closer to the road, causing Stevens to run after it. Mary Smith then approached Stevens again and struck him several more times on the head with the newspaper. Finally, Stevens left the dumpster behind, walked away from Mary Smith and said he was going to call police. In total, Mary Smith struck Stevens approximately twenty- four times. The entire incident was digitally recorded by Raymond.
