Week 1 Assignment

Facts of the case:
In this case, the government agents had scanned the exterior of Danny Lee Kyllo’s home late at night in Florence, Oregon with the help of an imaging thermal device. While scanning, the government officials found that some portion of the wall is emitting more heat as compared to other areas. At the time of scanning the exterior, the government official was not having any search warrant. After scanning of exterior and based on scanning and other pieces of evidence, the government officials obtained a search warrant and after conducting a search discovered that the defendant is growing marijuana in his home.
Kyllo was charged with the manufacturing of marijuana. He first tried to hide the evidence obtained and but later on, he appealed to the United States Court of appeal for the Ninth Circuit on the ground that the scanning done by government officials constituted a Search under the fourth amendment.
