A. Introduction:
Two parents (from Howard County) Kim Ford and Tracy Spiegel filed a case against Ho
ward County Board of Education at the Howrad County Circuit court. The lawyer from the petitioners side (Howard county parents and their minor children) was Anthony Conti and the attorney representing the board of education was Attorny Jonathan Backer. The judges were judge McDonald, judge Watts, judge Booth, judge Biran, judge Hotten, judge Gould, judge Harrell.
B. Discussion:
The lawsuit was filed to challenge the voting rights of student member of Howard County Board of Education after the student member voted to not re-open schools for in-person classes (Case number 18, 2021). The Howard County Board of Education has eight members and every time the voting was done, it resulted in 4-4 gridlock. The students could not go to school even if their parents allowed resulting in no choice for the students or the parents. Attorney Conti argued that the student member is a minor and can be allowed to give inputs from the students’ side (who are minors themselves) but should not have a binding vote. He further said that Howard County Board of Education is an elected board and not an appointed board. This violates the constitution of Maryland as members under 18 are not allowed to vote during elections or hold an office for elected member.
