Source 3: The landmark case in the second amendment is as follows: 1. New York State Rifle & Pistol Association, Inc. v. Case: A group of citizens living in New York challenged the provisions of city’s premises license. As per this law, none of the individuals are able to travel beyond the boundaries of the city with a handgun. This violated the Second Amendment rights and dormant Commerce clause. 2. The ‘gun’ ownership law of New York City: This restricts the transportation of licensed firearm from an individual’s house have violated the second amendment of the constitution as well the Commerce clause and the right to travel. 3. The issue: As per the Second Amendment, the Commerce clause, and the constitutional rights to travel, there is ban on travelling outside the limits of the city or to home, which is within the shooting limits with a licensed, locked and unloaded gun. 4. Grant of certiorari: The writ of certiorari was petitioned by the plaintiffs of Supreme Court which challenged the Second Circuit’s decisions and questioned if the banning on transportation of gun violated the rights to travel, the Dormant Commerce Clause and the Second Amendment rights. 5. The outcome: The Supreme Court ruled out that the petitioners claim for declaratory and injunctive relief is controversial. City of Chicago: It was affirmed that the right to keep guns at homes is a right which is incorporated against the states. As per the second amendment which gives right to the people to keep and bear arms in New York is unconstitutional and not to select on biasness as the state deems worthy. The NRA received friendly support from 23 state Attorney General which assisted to safeguard the fundamental rights of the citizen. This also included the right to bear arms for self-defense outside the home. This was NRA’s fight to secure the ability of all Americans to exercise those rights.
