Under New York v. Belton, the search of containers in the passenger compartment of an automobile is allowed incident to a custodial arrest. Should law enforcement offi cers wait until a defendant is in an automobile before making an arrest, when possible? Should offi cers make custodial arrests for offenses for which they would ordinarily not make custodial arrests?
