There are divided opinions on the actions that need to be taken, if at all, on global climate change. The United Colonies of Remedia had signed the Kyoto Protocol but has now withdrawn from it. Remedia argues that there is no scientific evidence that carbon dioxide is the pollutant that causes global climate change. The Security Council of the UN has approached the ICJ, requesting the court to enjoin Remedia to reduce its emissions, given the ICJ’s substantial historical and present contribution to total emissions. In its submissions, the Security Council argues that adequate precaution needs to be taken despite the fact that Remedia is not a signatory to the Kyoto Protocol. What should the court’s decision be?
