The physician plaintiff was licensed to practice medicine in Maine and, as a licensed physician, was a member of the Maine Medical Association. Following an informal meeting with the plaintiff, the association’s ethics and discipline committee, in a report, charged him with submitting invoices to the Maine Department of Health and Welfare that showed “gross overutilization, malpractice, and unethical practice.” The plaintiff was not informed of the charges against him before the meeting. The committee placed into evidence confidential documents used against the plaintiff without his consent. In charging the plaintiff, the association went against procedures established in its own bylaws, which required that ethical complaints be disposed of at the county society level.
