This is a familyowned and operated business that has been undertaking small biomedical engineering projects for hospitals. Historically, they have provided repairs and advice on the selection and testing of equipment to a range of healthcare facilities. There was little impetus to have a robust OHSMS, and the senior management was not that concerned with documented OHS systems. The new Managing Director is the son of the previous managing director and took control of the business shortly before you were appointed. The new managing director has identified a business opportunity to expand the types of engineering works they undertake. In particular, they are looking at applying for funding from the Advance Queensland Industry Attraction Fund (AQIAF): https://www.statedevelopment.qld.gov.au/invest/about-the-fund.html Biom Engineering to expand its in-house engineering capabilities and cooperate with other small companies and a local university to form a larger consortium with innovation and development capacity. Overall, the business is looking to extend on the scope of engineering works they undertake, including the manufacturing of prosthetics and implantable mechanical aids, which will require them to lease or buy black additional specialised equipment. They will also have to import in Australia new products and components, manufacture components as well as test and repair components. Currently, the business employs 20 staff. To render their funding proposal competitive, they plan to triple this number and engage specialist contractors and researchers. It is believed that the university partner and other specialists would share some “on base” facilities for the consortium to use. The Chief Operations Officer (COO) has identified that to be successful in the application, they must demonstrate they satisfy due diligence requirements and have considered various risks, including the ones relating to industrial relations and WHS compliance. Though you had commenced developing a suitable OHSMS for the current work environment, there will be a change in scope of works for the business, for example, managing and coordinating partners and contractors which they have not undertaken before. The business is currently operating under an OHSMS that requires updating. The COO thinks that this is an opportunity to upgrade their OHSMS to meet the AS/NZS 45001:2018 standards. The COO has tasked you to provide a detailed report to the Managing Director to inform them of the (1) Company’s key functions and responsibilities about OHS legislative obligations, so they can appropriately understand the impacts, concerning OHS, on the change in direction they are seeking to take, and (2) the key OHS areas they may need to address and key improvements to their OHSMS that is likely to be submitted as part of the application process. The COO does not want changes in the current OHSMS yet as this is a strategic appraisal. You are not asked to redesign the OHSMS but submit a report only. The COO wants the report to be structured so that it is clear what the OHS-related responsibilities of the company are and how that can be exercised in the context of the business and the company’s officers and staff. The COO has provided job descriptions of key personnel, which are at Attachment 1. Besides, the COO wants your thoughts on “five” key topics (in order of priority) for improvements to their OHSMS that will address legislative compliance for this new scope of work. A copy of the current Company’s OHSMS Index is at Attachment 2. The COO wants your opinion supported with academic, legal and at least one (1) case law references. She is encouraging you to support your views with academic insight, as well as relevant case law precedent since your assessment will be added to the Business Risk Register. The Managing Director is an Engineer by qualification and prefers an evidence-based approach. Your research should include at least ten (10) quality reference sources; your key OSHMS improvements should highlight five (5) key topics and why they need to be included in the company’s management system. Introduction
Biom Engineering started as smaller-sized family owned entity initially focussed on small scale engineering needs at hospitals. The company at present seeks to expand its business by leveraging the funding opportunity possible from the Advance Queensland Industry Attraction Fund (“AQIAF”). In its current stage, due to the limited scope of its business and operational activities, the company’s commitment, focus, and robustness of the Occupational Health & Safety Management Systems (“OHSMS”) is fairly limited. Further the company does not have any documented form of Occupational Health & Safety (“OHS”) systems.
In this context, this report presents discussion as well as recommendations in terms of the company’s legislative obligations under OHS and the improvements to its current OHSMS in face of the proposed expansion.

OHS Legislative Obligations
The overall legislative framework that shall be applicable to Biom Engineering and over which complete understanding in terms of obligations as well as safety requirements shall be essential will include the following: [1] Work Health & Safety Act, 2011 (“WHS Act”) and the same imposes obligations over people in the workplace for the purposes of making sure effective work health as well as safety, [2] Work Health & Safety Regulation, 2011 (“WHS Regulation”) and the same describes set of various actions which are essential to be undertaken to ensure the control and / or else prevention of specific hazards that can cause illness, injury, or death, and [3] Work Health & Safety Code of Practice (“WHS CoP”) and the same has been designed for the purposes of offering practical advice with respect to the ways for managing any exposure towards risks that are common in the industry (Matthews et al., 2019; Liu et al., 2019; Maceachen et al., 2016).
In case of there being any regulation under these WHS legislative frameworks which describes the ways for managing the risks in a business, Biom Engineering needs to follow, adhere and comply with the same. With respect to WHS CoP, duty holders at Biom Engineering shall be required in complying with the approved set of CoP as mandated as per WHS Act, or else follow with any another approach, like that of applicable industry or else technical standard, in case the same offers equivalent or else higher levels of standards for work place health as well as safety as against the standards which are prescribed under WHS code. In case of there being no relevant regulations, or else CoP, one need to undertake reasonable level of precautions as well as choose suitable ways for the minimisation of risks (Matthews et al., 2019; Liu et al., 2019; Maceachen et al., 2016).
The overall WHS legislative frameworks applicable to Biom Engineering which includes WHS Act, WHS Regulations, and WHS CoP essential mandates the following OHS obligations: [1] ensuring safer systems at the work place, [2] ensuring safer usage as well as handling of the various goods, materials, substances and equipment, [3] offering information, instructions, trainings as well as supervision for the workers and employees in ensuring that they work in a safe manner, [4] assessment of risks as well as implementing suitable set of measures to control the risks, [5] make timely reporting of any notifiable incidents with the Workplace Health & Safety, Queensland (“WHSQ”), [6] investigating incidents as well as taking action for avoiding similar incidents from happening again, and [7] providing compensation insurance or workers (Matthews et al., 2019; Liu et al., 2019; Maceachen et al., 2016).
The overall WHS legislative frameworks applicable to Biom Engineering the framework for the purposes of protecting the overall safety, health, as well as welfare concerning all of the workers in the workplace.
