Summey Building Systems built a condominium project in Myrtle Beach, South Carolina. The project included an adjacent parking deck. Shortly after Summey relinquished control to the condominium association, the deck began to experience problems. Water and caustic materials leaked through the upper deck and dripped onto cars parked underneath. Cracks appeared, and an expert concluded that the bond between the top deck and the structural supports was insufficient. Repairs would cost about $205,000. Summey had never warranted that the deck would be free of all problems. Is the company liable for the repairs?
