Federal magistracy positions are important legal posts that carry important responsibilities and authority. Considering that the judges of the United States are qualified to serve for life, their selection requirements must be set at a high level.
First, a federal judge has to be a competent prosecutor. While this is not a legislative necessity, judges are unlikely to receive senate confirmation without this training. For example, it has been more than half a century since a court was named to the Supreme Court of the United States that did not have a degree in law.
Second, a judge should be of age to qualify for senior status under the Rule of 80. Rule of 80 specifies that a judge may assume senior status at the age of 65 if they have federal judicial experience of at least 15 years. The senior status allows older judges to reach voluntary semi-retirement, which is typically considered advantageous by preventing elderly and infirm judges from continuing service.
A third factor is the candidate’s previous experience in the courts. For example, over 46 percent of the newly named U.S. until their appointment, judges of the district court served as state judges or federal magistrates. The majority of the rest were attorneys with successful careers in litigation, many of whom had prior judicial experience.
