Introduction
The reason and purpose of the exc
lusionary rule, and also the alternatives to the rule, will be examined in this piece of writing. The costs and advantages of the exclusionary rule, as well as various solutions to the rule, will be discussed in this analysis. My opinion on the exclusionary rule will be explained, and evidence will be shown to back it up. First and foremost, the exclusionary rule must be clarified. The exclusionary rule is a legal principle that bans evidence from being used in court that was not legally obtained or that violates a defendant's Fourth Amendment rights. The goal of this regulation is to prevent federal agents from conducting improper warrantless searches and to give defendants who have had their rights violated options. There are a few exceptions to this rule, but we will just cover the three most prevalent ones in this assignment.
Analyze the Rationale and Purpose of The Exclusionary Rule
I will go into depth about the exceptions to the exclusionary rule now that we've covered the history of the rule. Some may believe that evidence obtained unlawfully cannot be utilized, yet there are exceptions, if any, that enable illegally obtained evidence to be assessed. The first exemption is the Good Faith exception, which permits authorities to use evidence collected under an unlawful search order. The evidence is admissible since the officer believed they were operating in good faith and within the parameters of their protocol.
The Independent Source Doctrine is another exemption to the exclusionary rule. "Evidence gathered during an unlawful search or seizure may subsequently be accepted if the evidence is gained through a legally legitimate search or seizure," the Independent Source Doctrine explains (Ferguson, 2019).
