Does forensic science have sufficient safeguards to avoid misuse of evidence in court
situations?
It is a fact that though forensic science can now claim to have embraced technologies and
strategies to prevent the misuse of evidence in the court of law during any legal proceeding, still
now it seems that forensic science is lacking proper safeguards in preventing such misuse. The
DNA test can be considered as one of the greatest achievements of forensic science and it should
also be considered as one of the effective means of proving certain crimes. But this method
applied by the forensic experts is also not flawless and it is a fact that recently there have been
many occasions in which it has been found that DNA test results have been manipulated or have
been rendered wrongly. Recently forensic evidences like DNA test reports, as evidence, have
been vehemently challenged and “Laboratory temperature variances are a source of challenge
because DNA is very sensitive to environmental conditions and…If the sample evidence is
contaminated before PCR amplification, the identity of the donor may be masked by over
amplification” (Shelton, 2009, p.324). So, judging from this angle it can be said that still now
forensic science cannot claim to have formulated methods of safeguarding evidences from being
misused in court situations.
