External Analysis Because the industry that BBSI operates in is a unique industry there are many risk factors that come into play. Employee rights, safety, healthcare and transportation are all heavily regulated by our federal government that can have substantial impacts on a PEO and its clients. When you structure your relationship as an advisory one it is not only important to be compliant but to ensure that a client is compliant as well. This advisory and co-employment relationship puts BBSI into the position to assume the obligation to make wage, tax and regulatory payments in respect of their employees, thereby exposing them to client credit risks. Additionally, failure to comply with applicable laws and regulations could adversely affect both BBSI’s business reputation it can also cause significant monetary damage for themselves and their clients. State and local regulations also have an impact and can also cause a barrier to entry into additional states. To operate effectively in a new state, BBSI must obtain all necessary regulatory approvals, adapt procedures to that state’s regulatory requirements and modify service offerings to adapt to local market conditions. Several states also offer their own workers compensation pool and some even require clients to use their state option BBSI might not be able to financial compete. Additionally, PEO’s tend to follow the cycles of the Dow Jones and tend to feel big impacts of economic fluctuations. Weak economic conditions typically have a negative impact on small-and mid-sized businesses, which make up most BBSI’s clients. When the economy is weak or heavy regulations are put into place these businesses could cut costs, including trimming employees from their payrolls, or closing locations or ceasing operations altogether.
