You are a Safety Consultant and have been engaged by ‘The Loft’ owners to assist in meeting their duties and obligations in terms of the Work Health and Safety Act.



Background information


Jane Smith and Billy Longfield are the owners of The Loft.


Jane and Billy want to ensure that they are doing all the right things by their staff and clients. Billy has candidly confessed that he has "no clue" when it comes to his duties and obligations in terms of Work Health and Safety legislation.


Some of the activities held at The Loft include:



  • Outdoor public events

  • Live Bands play on certain nights

  • Hosting of special events e.g. birthdays, weddings


There is a fully licensed bar, restaurant and café on site.


The Loft employs 8 full-time staff:



  • Operations Manager

  • Business Manager

  • HR and Finance Manager

  • Chef

  • Bar Manager

  • Security Manager

  • Maintenance Manager

  • Events Manager


50 part-time contractors such as bar staff, cleaners and security guards. The venue will sometimes hire on extra staff during busy periods usually university students looking to earn extra cash.


The organisation’s licensed hours are from 10 am to 12 am (midnight). There are 2 shifts for the venue:



  • Day shift 10am to 5pm

  • Night shift 5pm to 12am


The Loft has the capacity to hold 200 patrons.


Your assessor will assess your ability to clearly communicate WHS information to Jane and Billy (appropriate vocabulary, structure, layout and language) as Jane and Billy are not specialists in health and safety knowledge.




For these projects are you are required to demonstrate your skills in assisting with identifying the legal framework for health and safety in the workplace.

Obligations


Management is firmly committed to a policy enabling all work activities to be carried out safely, and with all possible measures taken to remove (or at least reduce) risks to the health, safety and welfare of workers, contractors, authorised visitors, and anyone else who may be affected by our operations.

List Jane and Billy’s obligations and duties under the WHS Act as PCBUs.
The primary duties of a PCBU include ensuring that-
· Providing and maintaining safe working environments, equipment, systems of work, safe storage of structures and substances.
· Providing facilities and making them adequate as well as accessible.
· Providing training, instructions and supervision
· Monitoring health of workers and working condition
· Maintaining accommodation and ensuring safety of workers in these premises.
A PCBU must also consult with workers regarding their facilities and welfare. They must also ensure that means of entry and exit of workplace is safe and that structures, fixture and fittings are all safe. A PCBY must also ensure that risks to health and safety must be eliminated. If this is not possible, the it must be minimized. Hierarchy of control measures may be applied in relation to risks.

A PCBU must also consult with workers regarding their facilities and welfare.
They must provide and maintain a working environment that is safe and free of risks to health, so far as is reasonably practicable.
Employees must be provided with necessary information, instruction, training or supervision that enables them to work in a way that is safe and without risks to health.
PCBU must ensure not to endanger other people (including customers).
