Explain the Fourth Amendment and the challenges it faces in the post 9/11 era.

Amendment came into being as a part to the Bill of Rights and this Amendment
ensures the right of the American populace n
ot to be subjected to unreasonable searches and
seizures and it makes sure that the right of the Americans to remain secure in their persons,
houses, and papers is protected (“Fourth Amendment”, n.d.). But after the attacks of September
11, 2001, there have been massive changes made to the laws of the land and due to the
emergence of these new genres of laws the effectiveness of the 4
th
Amendment has been
diminished. The primary challenge that the 4
th
Amendment is facing after the 9/11 attack is the
passing of the Patriot Act which the Congress passed after the deadly and devastating terrorist
attacks of the 9/11 enabling “federal agents to write their own search warrants in violation of the
Fourth Amendment and does away with the FISA-issued search warrant requirement” (Nimmo,
2013). It is now being considered by the majority of the American populace that the right to
protect one’s privacy is a fundamental right and to uphold the 4
th
Amendment is also very much
constitutional but such they are of the opinion that in order to carry on with the war against
terrorism the U.S. government is actually curbing some of the fundamental rights of the U.S.
citizens. It is a fact that for the sake of ensuring the protection of the country from the menacing
attacks of the terrorists “In recent years, law enforcement is using new technologies like global
positioning systems and video surveillance” (“The Constitution Today: Fourth Amendment”,
2011) and this in turn is threatening the existence of the 4
th
Amendment.
