He wants to start his own French restaurant, but he lacks the needed start-up money. Tweedy’s wealthy Uncle Tupelo wants to help Tweedy out, and he makes the following promise. “I think you’ve got what it takes. I am going to give you $10,000 to get this project off the ground.” Tweedy is ecstatic. 1. Differences between strict liability and negligence and an example of each of these tort actions.
Negligence refers to a situation when a person do not behaved the way a reasonable person is supposed to be under given conditions and cause any harm to the third party.For example, A got an accident with B, as A fell asleep during driving and cause harm to B. This is due to negligence of A as reasonable person do not behave this way.
On the other hand, Strict Liability is a liability one has to assume even he does not intend to harm others, so it is a liability without fault or irrespective of fault. For example, an aviation accident happened .In this accident, there is not any fault of the pilot, but the operators of aircraft under law are made to be charged for ground damages. So this is a kind of imposed liability.
