A public school district enacted a dress code policy that prohibited students from wearing "any t-shirts with messages." The school was responding to recent controversies surrounding the messages on certain students' shirts supporting various political candidates and social causes. The district argued that the t-shirts could distract students from their work and threaten school unity.


A high school student came in wearing a t-shirt that read "#ATLstrong" and was sent home. The student returned with a shirt that read "Jones for President in '22" and was sent home again. Was the school's decision constitutional? Why or why not? If you do not think the decision was constitutional, how (if at all) could the dress code policy be amended so that is is constitutional?


Identify and discuss at least two court cases mentioned in the Hopkins text to support your analysis. Clearly articulate how these cases informed your own analysis/reasoning. Aim to use key concepts and doctrines discussed in class readings/lectures to support your argument.
