Introduction
This is a sustainability report that will be prepared after addressing all the ethical or unethical activities that are being performed in the Timberwell Constructions. The report consists of the points that have been violated under economic sustainability, environmental sustainability and social sustainability and what steps have been taken to stop these problems.
A) Economic Sustainability
i) Evaluating Financial Implications and Other Problems
As per the case study, it can be understood that the Timberwell Constructions are going through several financial implications that have made the company go through some financial losses and to overcome such losses, the management has decided to come up with some divisions that are related to legal charges and penalties. Therefore, the company Timberwell Constructions are liable to pay $200, 000 that is for the non-compliance of the laws related to the environment (Ede et al. 2017). Other than this penalty, Timberwell Constructions also paid a penalty of $4400, which has been imposed on the company depending upon the fair compensation and this has been charged due to the discrimination that happened in the workplace.
Moreover, the company has formed a centre named the rehabilitation plan that is related to the several residential projects where an amount of $440,000 was being paid by the management, which was because of the recommendations given by the audit managers. In addition to these, the LEP amendments have been identified and analysed in several rules and regulations so that the Timberwell Constructions succeeded to manage different type of expenditures, which was around $4 million, which was being spent in order to match the efficiency that was for the projects that were built, which were again with reference to those, which were related to the new standards. Adding more to it, the business entity paid around $50,000 to the external town that was planning to reduce the cost of the project that was being built as per the new set standards.
ii) Confirmed Incidents of Corruption and Actions Taken
Timberwell Constructions has accepted that the company has also been into the legal hearings and proceeding, which was related to corruption. As per the case study, a fraud scandal, in which the company was involved, was identified where some of the employees of the company were involved in this scandal. As per the news, the scandal was that these employees in order to make their work faster, they offer bribes to the government officers (Prager et al. 2019). Hence, the state corrupt commission charged legal actions against the employee and the company. Moreover, as per the outcome of the legal actions that were taken the authority, all the employees who were involved in the scandal were terminated from the job and were not even provided with the pay or the salary. Moreover, the business entities have also disclosed the partnership contracts that were made with some of the external firms (Caniato et al. 2017).
iii) Legal Actions for Anti-Competitive Behaviour, Antitrust and Monopoly Practices
According to the case study, some of the legal actions have been taken against the Timberwell Constructions by Australian Competition and Consumer Competition because of the anti-competitive behaviour that is taking place in the workplace of Timberwell Constructions. Therefore, as a result, the federal court has passed a hearing against the company because of the illegal practices that happened in the company.
As per the present case study, it has been identified that some of the anti-competitive activities have been done in the company where the business partners and suppliers have claimed that they were influenced by the company in the form of threat, which was being given to them. The reason behind this is many small companies are setting up their start-up and due to which the company was in a state of mind where it might happen that the new companies become a threat to the business or they might end up losing all the contracts and suppliers.
