Scenario: You are a Protective Service Officer at the Bracken Ridge Hospital which is part of the North Brisbane Hospital and Health Service (NBHHS). You are appointed an authorised person and security officer under sections 164-165 of the Hospital and Health Boards Act 2011 (Qld). Your role is to ensure the safety and security of people on health service land and to enforce a range of legislation that is relevant to your role. You are patrolling the grounds of the hospital with your colleagues, Protective Service Officer Michael Farias and Senior Protective Service Officer Marcus Deiley, enforcing the smoking legislation. * Please note that the Bracken Ridge Hospital and North Brisbane Hospital and Health Service are fictional and have been created for this assessment only.     As per the general overview of the given case study, section 166 (1) b and c and section 166 (2) of Hospital and Health Boards Act
2011 apply to the current scenario. Being appointed as the security officer, it is in the power to exercise patrolling and ensure that the premise is secured from the threats of trespassing as well as from other unwanted actions, endangering the lives of patients admitted to the office. Under section 166 (2), the issuing of the regulatory notice which is duly signed by the appointee, whomsoever it may be, allows this exercise of power to the security officers appointed at Queensland hospitals. It is in the nature of their duty to intervene legally in terms of managing the issues of public interest like enforcing smoking legislation.
