Introduction
Sentencing is an essential part of judiciary system. Justice against any crime or felony performed by an individual is liable to undergo hearing followed by an appropriate sentencing from the judge. However, it would be essential to consider that sentencing patterns as well as strategies have changed, and the implicated changes are being debated as well as questioned. This paper will focus upon some of the changes made in sentencing strategies, and efforts will be made to enlighten their impact on prosecution especially in drug offender’s cases.
Application of the Classical School in sentencing reforms
Classical School refers to the time around 18th century that is, during Enlightenment period, which is considered as bad for criminals as well as suspected individuals. The classic school of thoughts was based upon the ideology that people can freely make decisions based upon their will. This also implied that according to this theory, individuals at that time were free to choose from the type of crime they may want to commit. Further, this ideology also suggested that individuals try to avoid pain; as a result, they seek pleasure in committing crime. Accordingly, Koehler (2019) reflected and argued upon the fact that The Classic School suggests that, punishment will work as a deterrent to crime. In other words, individuals may not commit crime because they may fear the punishment. Likewise, this ideology also reflected that more severe the felony committed by an individual, harsher should be its punishment.
It would be essential to consider that, however, the strategies of classic school are still implied in today’s world, yet, there have been made numerous modifications.
