1. Draft research
Business profile and background of AgriFutures Australia
In the past, AgriFutures Australia was known as the Rural Industries Research and Development Corporation (RIRDC). The goal is to increase the long-term viability of rural industry in Australia. Emerging leaders in government, industry group, other RDCs and agriculture are among the people they engage with, they listen to and cooperate with (AgriFutures Australia, 2017).
According to the report, from a heavily government-funded sector to one that is almost totally private in the last 15 years, the Australian plant breeding industry has seen tremendous changes.
On January 1, 2013, the Australian government announced its high objective of tripling its agriculture productivity until 2030. Not unexpectedly, the number of novel plant types for which IP rights are sought has risen dramatically in the past few years.
Intellectual property profile
In order to safeguard novel plant varieties in Australia, AgriFutures Australia relies on patents and PBRs (Hardaker, Chudleigh, Abell & Henderson, 2018). Also, contracts, copyrights, and trademarks are all commercially important types of protection.
· Patents- unlike the United States and Europe, Australia's patent legislation is more permissive in terms of protecting plant types. Biomaterial, including plants, was declared patentable in the landmark 1959 case of NRDC v Commissioner of Patents (102 CLR 252). Plant variety patentability was recently confirmed by the Australian courts, who said that there is "no fundamental obstacle to patentability". A novel and unexpected outcome, or the adoption of breeding techniques that go beyond regular testing, are common signs of an innovative move in plant breeders. When it comes to Australia, only a "scintilla" of creativity is necessary to meet the criteria for innovative step. But it's evident that conventionally produced plants can fulfil these standards even if there isn't any particular case law in Australia dealing with plant breeding and innovative step.
· Trademarks- Trademarks are ‘signs' that allow products and services to be distinguished from one other in a competitive marketplace. There are many different types of signs that may be used. Roundup Ready, Massey-Ferguson, and Fair-trade are some of the most well-known agricultural brands. Unregistered marks may be rejected if they cannot be 'graphically represented.' This means that they are not clear and reproducible. Many activities, such as good faith and comparable advertising, may not be considered trademark violation.
· Copyrights- There is a copyright for literary works, artwork (paintings, photos) and musical and theatrical works. There is also a copyright for sound recordings and broadcasts, as well. Copyright material in Australia has moral rights attached to it at the time of its creation, according to Australian law. While copyright may be transferred and remunerated, moral rights are personal rights that cannot be. A writer's moral rights might be infringed upon if he or she agrees. For the Native Food Industry, copyright and moral rights are seldom a problem. One exception to this is when academics agree to recognise the contributions of Indigenous participants in exchange for access to and use of Indigenous knowledge. Co-authorship or some other kind of recognition might be used.
The case for intellectual property protection
There are significant differences between the patent system and the Plant Breeders' Rights Act (PBRA). There's a registration organisation that assesses the invention when the application has been submitted to them. For a short period of time, if the innovation fulfils specific criteria of novelty, non-obviousness, and utility, the innovator is awarded certain rights over the innovation. As a rule, these licenses also include exclusive right to make, market, and exploit the innovation (Clancy & Moschini, 2017).
Patents prevent others from copying an invention, but trade secret law enables them to do so if they can figure out how. Trade secrets have the ability to safeguard an innovation for the rest of its life, but patents only provide protection for a maximum of 20 years and demand full disclosure. However, Australian law now enables genetic material to be safeguarded.
Intellectual property best practice model under IP legislative
· Registering a domain name- Company may have their professional online presence by registering a domain name (for example, http://yourbusinessname.com.au/). Others have fewer restrictions. These are some of the most prevalent kinds. According to Sartipi, H, It is designed for Australian enterprises, commercial entities and charities to use the com.au domain, whereas asn.au is for non-commercial groups in Australia to use the org.au domain.
· Design protection- When it comes to a product, the Designs Act 2003 (Cth) aims to safeguard its distinctive aesthetic look. Enregistrement confers exclusive use rights to a registered designer for a specific product. A wide range of new goods that are both visually appealing and functionally or safety-improved can be created thanks to these unique rights.
· Copyright protection- Reproduction in material form is reserved for the owners of literary, theatrical, and musical copyrights (e.g. tracing a picture or copying some text by hand). Re-broadcast or otherwise convey a television or sound broadcast to the public. This automatic right exists as soon as a thought is written down or documented in some other way. The material does not require registration as mentioned by Sartipi, H. The usage of the asterisk (*) indicates that the work is covered by a copy left licence.
Strategic advantage of IP protection
· Collaborative approach – According to Grimaldi, Greco and Cricelli (2021), in their journal, managing the interrelationships between secrecy, usage of existing intellectual property, publishing of information, commercialization and decision-making surrounding IP rights may be difficult in collaborations. Collaborations can lead to the development of new intellectual property (IP) in the form of innovations, documents, goods, services, processes, software, and other materials. Project delays can be avoided if potential IP concerns are taken into account and managed properly.
· Open source option- The connection between open source software and intellectual property rights has raised some questions. Open source licenses have also been criticized by certain critics as being too broad. Software policy today is heavily reliant on striking a balance between fostering innovation and meeting the needs of both software developers and consumers. Since software publishers are more cognizant of property rights, as well as the possibility of court decisions clarifying the legal issue, no action is required (Grimaldi et al., 2021).
Recommendation for strategy development
AgriFuture Australia’s capacity to function may be hindered by patents and plant breeder's rights protection on native materials. In some situations, protection may encourage the Native Food Industry to invest in research. A fair license price may allow the resulting idea to be made available to the industry as a whole.
For the Native Food Industry, devise and implement a branding plan. The usage of botanical names cannot be restricted, but it is feasible to safeguard the industry's image by using intellectual property protection. For example, this might be used to investigate the strategy.

Task 2 – Develop and Implement IP Management Strategies
Part A: IP Protection Strategy Development
Strategic objectives
According to the Report on the AgriFuture, the business's governance and practices are affected by certain areas of legislation. Intellectual property strategic objective is to offer suggestions on how to make the applicable laws work for the native food industry. Two interrelated topics are addressed in this plan: intellectual property law and regulations governing use, transfer and access of native species’ biological resources (including native foods).
IP and the case for commercialization of IP
IP is an original thought or innovation that is economically (or aesthetically) valuable. Profiting from the IP by promoting a new product, production technique, or service that at least partially relies on it is called commercialization. As a...
