Plaintiff, J.G. Wentworth, S.S.C. Ltd. Partnership (Wentworth), is a leader in the structured settlement industry. It uses its Web sites at www.jgwfunding.com and www.jgwentworth.com to promote its services. Defendant, Settlement Funding LLC (Settlement Funding), is Wentworth’s nearest competitor. It maintains three Web sites, www.settlementfunders.com, www.settlementfunding.com, and www.peachtreesettle mentfunding.com. Wentworth sued Settlement Funding, alleging that Settlement Funding used Wentworth’s trademarks through Google’s AdWords program and in the “meta tags”for Settlement Funding’s Web site. Wentworth alleged that because of the inappropriate use of its trademarks, when consumers search for “J.G.
