INTRODUCTION
In the present scenario the fuel prices are rising, economic conditions seem dull and the competition is increasing in a greater extent [1]. It has brought a situation where the airlines need to think of new ways to be competitive and maintain their supremacy in the industry. In order to have the edge it is important to understand the functioning of the aviation industry, the regulatory bodies of the industry, the roles, responsibilities and obligations of the states and the service providers which are covered in this paper.
AVIATION INDUSTRY IN THE CONTEMPORARY WORLD
In the contemporary world, there are a number of successful airlines at a global level who are taking effective steps to engage with their customers and build long lasting relationships [1]. The trajectory of the industry is similar to that of an aircraft wherein at certain point of time it reaches high skies and suddenly it dips down to ground level. There is data getting generated at every point of time worldwide and there is a huge pile that gets accumulated at the end of the day. These data reserve contain many crucial information on passenger profiles, choices and preferences that keep changing every now then [1]. The airlines need to analyze the historical data, understand the requirements and has to provide offerings that appeals the customers in order to survive the global competition. There is always an increased focus on the Regulatory and Standardization that will dominate the aviation industry which will be continuing in the future as well [1].
HISTORY OF ICAO AND CHICAGO CONVENTION AND THE FLOW DOWN OF SAFETY IMPERATIVE FROM CHICAGO CONVENTION
The convention on International Civil Aviation was initially drafted in the year 1944 by fifty four nations and was established to promote cooperation, create an understanding between the countries [2]. The landmark agreement of the Chicago convention established the core principles that allows international transport to take place through air and a specialized agency was created which oversees it. The 2nd world war was a stimulator for the development of aircraft and air transport. There were studied initiated by the U.S government and it led to the International Civil Aviation Conference in the year 1944 at Chicago. 55 countries were invited out of which 54 attended and 52 of them signed the “Chicago Convention” and currently there are 192 signatory states to the convention. The primary objective of this convention is to expand international aviation in a secure and systematic fashion [2].
The Convention has two principal functions:
· Part I – Air Navigation which forms a base for international aviation law which is covered in Articles 1 to 42 [2]
· Part II – International Civil Aviation Organization (ICAO) is an organization which is created to look after the aviation in support of the international community by the Convention which is covered in Articles 43 to 66 [2].
There are two more parts of the convention address
· Part III – International Air Transport includes reporting of finances and navigation facilities of airports (Articles 67 to 79) [2].
· Part IV – Final Provisions explains on aeronautical agreements and various approval procedures (Articles 80 to 96) [2].
PART I – AIR NAVIGATION
It forms the basis for international air law. The main articles covered in this convention are sovereignty which gives every state complete and exclusive sovereignty over the airspace above its territory which is also defined in article 2.
