Abstract

The landscape of telecommunication technologies are rapidly changing. The
introduction of services which are digitally based the ability to effectuate court-
authorized e-surveillance consistently. This impedance hampers the law enforcement’s

activities. So in order to overcome and combat this emerging threat and to protect the
public safety CALEA came into being to help facilitate police and other related officials
carry out digital wireless surveillance. To make this happen, careers and communication
centers around the world need to either modify or check against if their policies match
up to that of the policies lay down by CALEA. However does the benefits that comes
with CALEA compliance outweigh the issues that come with it such as privacy issues, is

Introduction

CALEA was enacted by Congress on October 25 1994. As per CALEA, a
“telecommunication carrier” requires to make sure that any equipment, facilities or
services which allow customer or subscriber to terminate or originate direct
communications, enable law communication officials to perform electronic based
surveillance to perform court order or other lawful authorization. This law was purposed
at preserve the law enforcement agencies’s ability to conduct electronic surveillance by
ensuring that telecommunication carriers and telecommunication equipment’s
manufacturer has the capability to modify and design their facilities, equipment and
services. The laws ensure that telecommunication carrier and equipment manufacturer
to have necessary surveillance capabilities as and when technologies of communication
network evolve. In May 2006, the FCC issued a Second report and order which required
telecommunication facilities-based broadband Internet access providers and network of
interconnected provider of Voice over Internet protocol service to comply with CALEA
rules by May 14 2007 (THE COMMUNICATIONS ASSISTANCE FOR LAW
ENFORCEMENT ACT OF 1994 (CALEA)).
