Introduction
The
Human Resource Policy and the Manual for XYZ Corporation effectively outline the commitment of the company to comply with the applicable employment and labour laws in the organisation. It is inherent to consider that the company recognises the employees who are the most valuable asset and the company is committed to provide a safe and a fair workplace for all of them. We believe that compliance with the employment and labour laws is not only the legal obligation but also and ethical responsibility. The Human Resource Department is dedicated to treat all the employees with respect and dignity and this policy and manual serves as a guide to achieving the goal. This policy and manual will provide guidance on how the company adheres to the relevant employment and labour laws. It will also outline the expectations for the employee conduct, performance management, recruitment and hiring, employee benefits, and discipline and termination. The Human Resource Department of the company hopes that this policy and manual will effectively fulfil and serve as the useful references for the employees and managers of the organisation. The Human Resource Department of the corporation encourage all the employees to read and understand this policy and manual thoroughly to seek clarification if needed.
Employment & Labour Laws
This section outlines the relevance employment and labour laws that applied to the XYZ corporation and its employees. These laws aim to protect the rights of the employees and ensured fair treatment and promote safe healthy working conditions. By focusing on these laws, the corporation aims to create a workplace that is fair and respectful to the employees’ rights. This section presents a brief assessment of the laws and how it applies to our company and its employees (Warner et al., 2021).
A. Occupational Safety & Health Act
Description of the Act: The Occupational Safety and Health Act is the federal law that was enacted in 1970. This particular law focuses on the aspect that the employers are to provide a safety and healthy working environment for their employees by adhering to the established safety and health standards. The law also provides employees with the right to file complaints about unsafe working conditions without the fear of retaliation (Raynolds et al., 2020).
Purpose of the Act: The reason for the law is to guarantee that each specialist has the privilege to a protected and solid work environment. This law sets minimum safety and health standards that employers mass follow to protect their employees from home. The act also provides workers with the right to access information about the hazards in workplace and to file complaints if they believe their employer is not a providing a safe working environment (Petach et al., 2020).
Adherence to the applicable law: XYZ corporation is committed to develop a safe and healthy working environment for all the employees. To comply with the regulation of the Occupational Safety and Health Act regulations the corporation will:
· Identify the potential risk in the workplace and take steps to eliminate or minimise them.
· Provide a training to the employees on how to work safely and use protective equipment properly.
· Maintain accurate records of the workplace injuries and illness.
· Provide Employees with access to information about hazards substances in the workplace.
· Encourage employees to report unsafe conditions or hazards in the workplace without fear of retaliation.
· Investigate and promptly address any complaints or reports of unsafe working conditions.
All the employees are required to adhere to the regulations and guidelines of OSHA. If the organization fails to comply with the regulations, this can result in disciplinary actions. The organisation also encourages the employees to report any answer working conditions or hazards to their supervisors or the Human Resource Department promptly.
B. Family & Medical Leave Act
Description of the Law: The Family and the Medical Leave Act is the federal law that ensures that the eligible employees are able to take up to 12 weeks of unpaid leave in a year for family and medical reasons (Patil, 2020). This particular law mainly focuses to private employers with 50 or more employees. Employees who take leave under this particular act are entitle to job protection and continuation of Health Insurance coverage.
Purpose of the law: The purpose of the law is to justify the demands of the workplace with the requirement of the employees to take leaves for the family and the medical reasons. The law provides job protected leave for the employees to take care for a new born child or any other family problems. The act ensures the employers who is prohibited from discriminating against employees who exercise their rights under the law (Mückenberger et al., 2020).
Adherence to the applicable laws: The corporation is committed to comply with the regulations and provide eligible employees with necessary leave for family or medical reasons. To adhere to the applicable laws the corporation will:
· Notify all the employees of their rights under the FMLA.
· Maintain accurate records of the employee leave taken under FMLA.
· Provide Employees with necessary leave for family or medical reasons up to 12 weeks in a year.
· Provide job protection and continuation of Health Insurance coverage during the leave.
· Prohibit discrimination or retaliation against the employees who exercise their rights under FMLA.
· Provide reasonable accommodations to the Employees returning from the leave as required under the Americans with Disabilities Act (ADA).
All the eligible employees are entitled for leave and are encouraged to communicate to the supervisor or the Human Resource Department (Raynolds et al., 2022). The organization must take effective actions against the relevant decisions. And the organization is committed to develop and offer a work environment that supports employees to balance their professional and personal responsibilities (Nuriddin, 2020).
C. Affirmative Action
Description of the Law: Affirmative action is a set of policies and practices design to address the past and present discrimination against the individuals from certain groups including women and minorities or individuals with disability. The law ensures that the federal contractors and sub-contractors with contracts of $50,000 or more to have a written affirmative action plan (Onakoya, 2020).
