1. Introduction to the Chosen Case Study and Applicable Theories
The paper is a discussion of the application and evaluation of the ethical theories on “Community Treatment Orders”. Community Treatment Order (CTO) is the set of rules under Mental Health Tribunal or a magistrate to help the people with severe mental health issues. According to CTO, a person with severe mental challenges must follow the treatment procedures living in the community (Beckett & Horner, 2015). CTO provides the option to a mentally challenged person to take outpatient treatments as and when they are not able to take their own decision about medication. In regard with human rights and right to health, they are allowed to take clinical medication being outpatient in the community.
CTO allows the person to stay in a minimum restrictive environment. It was first created in the USA, followed by Australia and New Zealand. It is also accepted by European countries. The CTO will only be imposed over a person after the tribunal is satisfied with the person’s medical history, his denial to take treatment from mental care being inpatient, or live in a less restricted community. CTO provides outpatient mental health care to the persons with its own treatment plan. If the patient denies undergoing the treatment plan or breaks any rules of CTO, or even shows any decline in their mental state, then they will be again inpatient with proper medical care and supervision in a mental healthcare (Garvin & Reed, 2017).
However, imposition of CTO over a mentally challenged person have been partially supported in many countries, stating that it may hamper the ethical issues of the society and the community, or may affect the patient’s mental health who is already indecisive about their own care. Therefore, there have been argumentative and confusing views over this topic. The theories of Care Ethics and Act Utilitarianism can be applied in such case for a further analysis on this case.
2. Facts from the Case Study
The application of CTO in the society has been a matter of argument over the period of time. While CTO aims at reducing the financial and medical challenges of mentally ill persons, it has also been criticised for not being able to provide justification to human rights. This can be analysed based on the dilemma arose, statistical and evident basis analysis, and the government’s take on this regard.

The CTO’s imposition is at many parts questionable by the proponents. This concern relates to the breaching of Human rights as when the mentally challenged patients are not decisive about their wellbeing, if they can be left without any support in a community. This also has become a matter of concern in view of the right to health that if a person is unfits to live independently, in a society and is still left without proper supervision, even when the medical treatment should have been continuing, then this may become a threat for the individual and also to the community (Fritze, 2018).
