Core elements of WHSMS Organisational requirements It is a legal requirement in Australia to implement health and safety practices in the work place as soon as the business commences its operation. This is mainly carried out to ensure a safe work place for employees, contractors, suppliers, volunteers, visitors, customers and even public. When the Pitstop owns only one fuel station, it was easy for Jim to carefully train the staff about work safety and can eliminate any potential hazards before they cause an injury. But as the Pitstop bought the new 9 ISS stores around Australia, now it has become a necessity to develop, implement and maintain a proper and common WHSMS for all the stores which Pitstop owns. In order to ensure a safe workplace, certain policies and procedures must be developed. Responsibilities and accountabilities for WHS The various responsibilities of management for WHS include the following: · Provide safe workplace for employees, suppliers and customers. · Assess potential risks and figure out ways to eliminate them. · Provide and use safe machinery and equipment. · Provide user manuals and safe operating procedures for all machineries · Assess workplace layout and label the fire exits visible to employees and customers. · Have insurance for the business as well as for the employees. · Provide training to employees about various safety measures. · Ensure the availability of first aid kits in the store. · Provide first aid training at least to all managers and supervisors and ensure that all managers have valid first aid certificates. · Provide all employees training on how to operate new ovens and how to clean them. There are various responsibilities to employees as well. They are: · Follow safe operating practises and standard operating procedures while working. · Use appropriate Personal Protective Equipment (PPEs) while operating machineries. · Do not misuse any equipment provided for WHS. · Report management or supervisor about potential hazards. · Use sign boards while the surface is wet and clean the spills immediately. · If you are unsure about something, please ask your supervisor. · Please check and record the temperature of the refrigerators and freezers at the start of the shifts. · Follow safe lifting practices while lifting objects. WHS risk management and procedures WHS Risk management and procedures are those standard operating procedures that are specifically designed to set out step by step instructions to carry out a job or task. These procedures are essential for Pitstop as it enables the company to demonstrate that it addresses health and safety obligations. Moreover, it also helps to show that Pitstop is committed to working within a close set of health and safety principles. By gathering information from the summary of incident reports provided by Amanda, it is clear that the major incident that affects the employees is the burns from oven. There are 42 such incidents and lost 23 working days because of this incident. This incident mainly occurs due to the lack of training and also due to the lack of operating procedures. So in order to eliminate these issues in future, the employees should be given proper training and insist them to use appropriate PPEs while using the oven. In order to develop a proper risk management procedure, the best way is to identify the hazard and fix them. The hazards in the work place can be identified with the help of consultation with employees and key stakeholders. Once the hazard is identified, then the next step is to analyse the hazard and then determine the likelihood of the hazard and then the final step is to eliminate the hazard. There are two Australian standards relating to the design and implementation of WHSMS. They are: · AS / NZS 4801: 2001 Occupational Health and Safety Management Systems – Specifications with guidance for use and · AS / NZS 4804: 2001 Occupational Health and Safety Management Systems – General guidelines on principles, systems and supporting techniques. Documentation and recordkeeping requirements for monitoring and review In order to develop the WHSMS, a store visit was conducted to gather information about various hazards in the workplace. While checking the records it was observed that no training records were kept for employees and contractors to provide the evidence of the work place competencies. Moreover, no rehabilitation policy was there. There were missing incident reports and the records relating to the workers compensation claims were kept in an unlocked cabinet. It is a necessity of WHSMS to keep the records of training and other reports such as incident reports, documents of site inspection, tests and maintenance, register of hazardous chemicals, Material safety datasheets for chemicals etc. Proper record keeping practices helps the management to conduct reviews about the incidents and it also helps to review the performance of the company. Employee capability and need for training By conducting the store visits, it was evident that the ISS didn’t carry out any training to their employees and no training records showing the workplace competencies of employees and contractors were obtained after meeting the record clerk. From the summary report provided by Amanda, it is clear that burns from oven is the most frequent incident that occur in the new stores and the main reason for this incident is the lack of training given to the employees for operating the ovens. Just an instruction manual translated from Japanese was given to the store managers. So to avoid such mishaps in future, all the employees should be given proper induction and training and promote them to use appropriate PPEs while handling these machines. Not all the managers were given first aid training and as a part of new WHSMS, it should be made compulsory for all the managers and supervisors to get the First aid certification. It is the responsibility of managers to ensure that their store has first aid kit and replenish the items as needed. The company also decide to introduce stress mats for the counter as the cashier has to stand for long time and we also decide to put another staff for relieving the cashier after every 2 hours during peak times. We also decided to introduce a manual handling policy so that the maximum weight our employees have to lift will be less than 15 KG. As the Pit stop Pty Ltd is a wholly owned private Australian company, certain legal regulations need to be implemented to improve the safety and health practices in the corporate. In order to achieve
a safer environment at workplace for every person in this business such as employees, contractors and consumers, Workplace health and Safety Management System can be proved beneficial as it will reduce the risk and potential hazards at the place of work. Pit stop needs to provide the customers, staff members and the other associates a risk free and shielded atmosphere so that the decorum of the company can be maintained (Gómez et al., 2018).
Organizational requirements
At the very starting, Pit stop owned only one fuel station and at that moment the employees were less. The basic safety procedures and instructions were conveyed the staff with ease however the company has been expanded now and the number of associates have increased dramatically at this point of time. There is a need to implement the regulation and train each & every staff about the work safety and risk management steps. Also, it is a basic legal requirement in the country to implement safety and health guidelines or act to ensure the well- being of people associated with the business from the injuries and potential hazards. As soon as these regulations will come in effect, there will be a composed and contented atmosphere.
Responsibilities and accountabilities of Workplace Health and Safety regulation
The accountabilities and responsibilities of WHS are as following :-
1. To ensure the protected environment to the people in business including the staff, suppliers, contracters and costumers.
2. Get to know about the potential risks at the workplace after consulting with a group of workers or individually. This is to be assigned to a particular responsible person who can approach the members and get updated about the current potential hazards in the office premises. He must be responsible for getting the risk eliminated at the earliest before it could harm or injure anybody.
3. The staff should be provided with the safest machinery or certified equipment so that the risk can be reduced. Then after providing them to the individuals, they must be educated and trained about the basic operation of the machinery and handling the equipment without risk.
4. Proper user manual with instruction should be provided so that the employees can understand the working and use the tools and machines in the way specified only.
5. To assess the graphical layout of the place and install the pre- inspected fire extinguishers which must be located at a visible place for the customers and workers. In case of emergency, the people can use them to fix the issue. The people should be guided practically to use them and get ready for the situation if happens.
6. One of the basic responsibilities will be to have the insurance of the business. In case of a mishap or harm happened to the business, the management can claim reimbursement for the situation. The people working must be insured as well as they can also claim compensation for the harm caused to health and belongings. It will be similar to a safe and secure firewall which will not just reduce the risk however in the meanwhile the things covered in the insurance will be replaced like before.
7. To guide or train the employees with the safety measures which can be implemented at the time of mishap. This awareness will be proved handy at emergency hours and will eliminate the risk from its root.
8. To make sure that First Aid Kits are available anytime in the store rooms or any visible place. These can be used to heal any injury caused if the fire breaks out or in case a heavy load falls on body part etc.
9. To provide senior officials such as supervisors and managers with the certificate and relevant documents after completing the First Aid training as they are the first hierarchal approach to a associate and they need to be trained, educated and awared to fix the issue. These official will be responsible to lead the crew at the emergency hours and get the error or risk eliminated.
10. With the advancement in technology, the equipment are updated and machinery is replaced. The effort will be to make the employees aware about the working of new tools, machinery or equipment, handling them safely and what to do after the work is done. The workers must be trained to use new ovens and cleaning the ovens safely is utmost important after the work is done as most often the injuries are due to carelessness or awareness of cleaning procedures (Oah et al., 2018).
The various accountabilities to employee are as following:-
Follow the operating practices as per the standard and use the equipment safely. The employee must use the safe and standard operating procedure as the reference book or user manual. Any carelessness can lead to tremendous and massive destruction or injury.
The PPE’s (Personal protective equipment) must be worn at the time of work. These are the equipment which are used to minimize the exposure to hazards which can cause serious illness or injuries at the place of work.  These injuries & illnesses may occur from contact with chemical, radiological, electrical, mechanical, physical or other workplace risks. Personal protective equipment may include things such as gloves, safety glasses and shoes, hard hats, respirators, earplugs or muffs or coveralls, vests and full body suit etc.
To make sure that no one is misusing the equipment provided for WHS.
The employee should take responsibility to report any potential hazard which can be dangerous before it harms anyone.
The workers should put the sign boards if they are cleaning the floor and is wet. The people will go another way and they will be secured from any slipping issues.
The employee need to ask the authorized person if he is unsure about anything related to working or anything. Any heedlessness in this can harm him or her or can lead to an extended harm caused
The temperature of refrigerators and freezers should be checked and recorded as soon as the shift starts.
The safe lifting procedures must be thoroughly carried out to minimize the harm (Khakurel et al., 2018).

WHS risk management and procedures
Work health Safety and procedure refers to the steps taken one by one to do a particular task or job. These are very important for the company in its own way as it helps in maintaining the safe atmosphere at the workplace.
Pit stop is committed to work on these close set of instructions which are same for everyone and it maintains the even way of working for the whole company.
Amanda took out a small survey in which she founded that the most incidents ever happened at the workplace were due to the oven burns. The company lost 23 days of working due to this and at the same time 42 incidents happened due to carelessness or unawareness while operating the equipment as well as lack of training badly affected.
By taking care of PPE’s, proper guidance and training and following the instructions carefully, these injuries can be avoided. This leads the development of national policy to improve work health and safety and workers’ compensation arrangements across Australia. It does not regulate or enforce WHS legislation. As a business owner, you must meet the WHS requirements set out in the acts and regulations in your state or territory. You may face penalties if you don’t meet them (Chari et al., 2018).
For monitoring and review, documentation and recordkeeping requirements
It is necessary to do store visit in order to collect information of various problems and risks of workplace so that WHSMS can be developed. All the records of training and various related documents and reports should be kept as it will help in future interactions and work. It is also a necessary part of WHSMS as proper record is needed in every work in the workplace. It will provide all the basic credentials and performance of the company. Future planning can be done by tracking the records of company.
Capability of employees and need for training
There is a strong connection between training of employees and performance of company. As analysis done on store visit and employees were lacking the desired knowledge that they should possess. Thus, it is required to provide training to employees about all the basics of company and work particularly. First training should be given and then proper promotion and place in the company should be provided according to the capability of person. A proper analysis needs to be done on the work of employees so that they can perform better and company can develop. It includes training of first aid also as a basic training in WHSMS so this training should be provided to each person of the company (Sorensen et al., 2018).

Thanks for your interest and performance in order to improve the WHS of Pitstop by compiling the summary report of incident.
According to summary report, the company found that burns arising from ovens is the really dreadful incident happening in new Pitstop stores, more than 40 incidents were recorded. It was due to lack of training provived to the employees and the reduced usage of appropriate PPEs. As an additional part of WHSMS, new rule includes that training will be given to all of the employees regarding the usage and cleaning of the ovens. Moreover, all the employees will be provided with PPEs for ovens to handle.
Also, the first aid training will be provided to each employee from top to bottom level and manager should have first aid kit also with them.
Manual handling policy will be set to less than 18 KG so that employees can take care of their health also. This rule will be implemented for manual handling employees.
These changes at the workplace would be done hoping to give a more safer work place to our employees, customers and suppliers.
