If the defendant loses, the defendant has to pay damages to the plaintiff.A crime is a wrongful act that the state or federal government has identified as a crime. A criminal case is a criminal proceeding. The accused is also called a 'defendant". The victim is the person who has been hurt or the state of Georgia or other governmental entity. Construction management should be educated in the field of Tort Law because as a Manager of people and a construction project there a lot of liabilities that could cause harm to other persons or property. Example would be that if you had an employee that wanted to cut corners and cause an accident towards other people on the site or property damage the manager should know the laws to protect the company's best interest. Also there are some instances where an accident can be taken to trial not only as a civil matter but also as a criminal case which can carry fines and jail time for example if an employee is on illegal mind altering drugs and cuts corners which causes a death on the job site he or she can be held on a criminal case for manslaughter which can carry heavy fines and jail time.
