Introduction
Since 1947, scholars have completed over 150 master's and doctorate theses, as well as more than 900 studies, papers and books on refugee settlement concerns in Australia (Neumann, 2016). Paper has find patterns in the literature, such as the rise of concern for the psychological and emotional effects of settlement an ethno-specific focus.
It is believed that researchers should assess the information that has been created thus far and become more aware of the international scholarly discussion. The scope of Australia's legal duties towards resettled refugees is investigated in this article. It looks at both the international frameworks that guide refugee rights and the relevant Australian laws and policies.
A comprehensive examination of how these regulations are enforced in the context of refugees necessitates a focus on the lived experience of settlement. The study finishes by pointing out the drawbacks and benefits of policy and law as tools for assisting resettled refugees in their integration, as well as some suggestions for how refugee resettlement in Australia may be improved.
Identification of Community
Under international law, the term "refugee" has a more particular meaning. The Refugee Convention contains the most commonly acknowledged legal definition of a refugee. It has been chastised for being overly restrictive, in part because it does not explicitly include typical reasons of mass relocation, such as war or general violence. The Refugee and Humanitarian Assistance Program issued 21,968 visas in 2016–2017, including 8208 slots for displaced Iraqi and Syrian refugees Australia (Neumann, 2016). Most territories and states have their own policies aimed at promoting refugee health, with varying objectives and aims. Refugees have access to Medicare Benefit Schedule item numbers once they arrive in the community, allowing a general practitioner to perform a refugee health assessment within the first 12 months (Matthews, 2008).
Classification
In recent years, the number of individuals abandoning their homeland in quest of a better life has risen substantially. There are many distinct sorts of refugees, each with its own set of reasons for escaping (Matthews, 2008). However, Australia has refugee and asylum seeker most commonly.
1. Refugee:
2. Asylum Seekers
3. Internally Displaced Persons
4. Stateless Persons
5. Returnees
6. Political or Religious Affiliation
7. Escaping War
8. Discrimination based on Gender/Sexual Orientation
9. Hunger
Although the UNHCR makes recommendations or suggests persons for resettlement, yet Australia's Immigration Department has the final decision on whether or not to issue a visa Australia (Neumann, 2016). There are four types of offshore refugee visas available in Australia:
1. refugee (visa subclass 200),
2. in-country special humanitarian (visa subclass 201),
3. emergency rescue (visa subclass 203) and
4. Woman at risk (visa subclass 203) (Visa subclass 204)
History of Refuges and Migration of People in Australia
The immigration history of Australia began with the initial human migration to the continent around 80,000 years ago. Permanent European settlement began in 1788 with the establishment of a British penal colony in New South Wales. From early federation in 1901, Australia maintained the White Australia Policy, which was abolished after World War II.
The Immigration Restriction Act of 1901 was one of the first acts introduced by the new Commonwealth of Australia, which was formed earlier that year. Its basic premise concerned the prohibition of immigration to Australia of those the Act referred to as 'prohibited immigrants' (Balint & Simic, 2018).
The Act also asked potential immigrants to write a dictation in a European language, which at that time shattered the hopes of most non-Europeans of being accepted in Australian territory. The first is linked to Australia's natural resources: Australia is rich in gold and thousands of people from around the world came to Australia during the 19th century's gold rush.
The second is related to the previous one, as well as to the political and economic situation in Australia. Today approximately two-fifths of all new immigrants to Australia are of Asian origin (Balint & Simic, 2018). Obviously, the list of the determinants of immigration to Australia presented above is not exhaustive. Our aim was only to point out those determinants, which have had considerable influence on Australia’s migration policy.
Distribution of Refugees as per Australian States
At the end of June, Australia's estimated resident population (ERP) by country of birth was calculated. Only the Census years are provided at the state and territory level; with the most recent being 2016. The most important discoveries in 2016, slightly fewer than 29% of Australians were born outside of Australia (Collins...
