This paper will review the legal implications of harassment and cyberstalking and the aspect of crime associated with the issues of online harassment and cyberstalking.
Cyberstalking
Cyberstalking focuses on using the internet as a medium with an electronic communication device to stalk another person. This may usually involve threats and damage to data. This also involves the aspects of sexual abuse and sexual for possess and any other form of repeated offensive behavior by communicating in a written message or any other forms of solicitation. Online harassment and cyberstalking can also involve sexual harassment which is unwanted and sending certain messages or multimedia files based on sexual activity that affects the dignity of women. It is also contemplative that in this digital world, the aspect of sexual attention is considered to be sexual abuse, if it is repetitive once it is rejected by the recipient. This can sufficiently be serious and can constitute to be harassment (Wilson et al., 2022).
This is a more like that of a crime that utilizes the internet and networking aspects to disturb and monitor a person. It is considered to be a part of cyberbullying and this can be done with the help of messages, emails, social media posts, and other mediums that is often persistent and methodical. This is often considered to be harmless but if such aspects become repetitive and systematic annoyingly or frighteningly this can be concerning (Stevens, 2019).
Cybercrime is to facilitated by direct communication always. It may happen that in some cases victims does not even realize that they are falling as a prey of online stalking. In some aspects, the victims are often controlled and spied through a number ways by using tools and information collected that can be used for crimes such as identity theft. Some stalkers plan for harassing the individuals offline as well as contacting their friends and relatives from a particular. Some of the feature of such crime involve breaching data privacy, monitoring online and real-world activities, and tracking locations. It is often realized from previous investigation that some people make false accusations and spread malicious rumors by developing fake social media profiles. At times people also involve in revengeful activities and publish revenge porn (Reyns et al., 2020). The misperception that in terms online harassment physical contact is not there so cybercrime is not as severe as that of the physical form of abuse.
