Introduction
The policing system is subjected to maintain the law and orde
r on top priority. In fact, there are some authoritative rights and provisions that make the policing procedure unique and superior to the common people (Ali & Clark, 2019). However, some special privileges—that are meant to be given to the police officers—enforce them to violate that thin line of distinction between being just and being partial in an act of crime. These acts are not criminal in some of the cases and it is the duty—or even personal accountability—of the police officers to recognize the sensitivity of the situation before initiating the investigation or detention. The following is an analysis of the ‘qualified immunity’ given to the police officers which has been revised by the Supreme Court in the recent years especially in the context of the case District of Columbia vs. Welby 2008.
Brief Overview of the Case
As per the general observation of the case study, the police officers of Columbia district were found involved in an objectionable detention. They were alerted by the neighbors that some kind of loud music was going on in a nearby house. It made the neighbors feel that the public nuisance was created by the partygoers in the house. To make the situation more suspicious than ever, the house was reported to be vacant. The police officers acted immediately over the alerting call and made a series of arrests; there were overall twenty one arrests that they made in the house, detaining all the partygoers present in the vacant house. The legal action was taken against all of them as they were causing trouble to the neighbors living nearby.
