FIVE MINUTE ORAL ADVOCACY REQUIRMENTS Five Minute Oral Argument Each parties arguments must be no less than four minutes and no more than five minutes long (8-10 minutes total). Please be creative and take on the role and persona of the attorney(s) representing his/her client (see the case through their eyes); destroy the box. One party should advocate the Petitioner/Appellant’s position, the other party should advocate the Respondent/Appellee’s position. Petitioners are usually the moving party who is seeking relief from the decision of the lower court (trial court or lower appellate court). Please ask if you are not sure which party is Petitioner and which party is Respondent. Thank you. Each party must submit an annotated outline that supports their position(s). In terms of intext citations, you will probably only need to cite name of case, specific language from the case/opinion, and the page from the published decision where the language can be found. However, if you cite language from another case, law review article, or legal publication (language/authority think is persuasive), you will need to provide the citations from that source. Please ask if you need assistance. You are required to submit an annotated outline. The annotated outline must contain the information from your oral discussion, with supporting evidence and citations. You are required to identify the source(s) that support your conclusions. This can be done jointly with you team member/opponent. During oral arguments, and in the annotated outlines, both parties must, with specificity: · Provide a brief and concise summary of the case, from their perspective. · Identify the applicable law and discuss the laws value (purpose), from their perspective. · Identify the key issue(s) in the case (reason for the dispute), from their perspective. · Identify agreed facts and cite language in the case that supports that position, if necessary. · Identify disputed facts and cite language in the case that supports that position, if necessary. · Discuss why the law involved in the case should be followed, modified, or rejected in general and/or as applied to the facts in the case. Once all cases and opponents have been finalized, I will email that information to all fours classes.
