Dr. Will Pirkey, a U.S. otolaryngologist, signed an employment contract in which he agreed to work for two years at the King Faisal Hospital in Saudi Arabia. Before his departure, Pirkey received his employment contract, which contained a clause providing that his agreement with the hospital would be construed in accordance with Saudi Arabian law. Because of the assassination of King Faisal and for other reasons, Pirkey did not go to Saudi Arabia as agreed and contested the choice-of-law provision of his employment contract as unconscionable.
