Exam Overview



  • The exam consists of 50 marks.

  • The exam consists of two parts each worth 25 marks.

  • Each part contains three questions:

    • Question A: 5 marks

    • Question B: 10 marks

    • Question C: 10 marks



Part 1
Part 1 examinesContract LawandBusiness Ownership. You only need to refer to these two areas of law in answering the questions in Part 1 and should not refer to other areas of law.For Part 1, ensure that you understand:

  • The different types of business structures.

  • The advantages/disadvantages of each type of business structure.

  • The rules and concepts of formation of contract, privity of contract, and breach of contract.

  • The concept of promissory estoppel.

Part 2
Part 2 examinesCompetition LawandEmployment Law. You only need to refer to these two areas of law in answering the questions in Part 2 and should not refer to other areas of law.
For Part 2, ensure that you understand:

  • Employers discriminating againstemployees.

  • The rules and concepts relating to mergers of companies.

  • The rules and concepts relating to anti-competitive conduct and cartel conduct.

Legal problem questions
Questions B and C of each part are legal problem questions. You must ensure that you answer these questions by applying the IRAC (issue, rule, application, conclusion) structure. The marks you receive for each question will be based on your application of the IRAC structure.We strongly recommend only dealing with one legal rule at time (i.e. state the legal rule and then immediately apply that legal rule. Sometimes, if two legal rules are closely related, you may state both legal rules and then apply them together. The structure you ultimately choose will depend on the legal issue, the legal rules, and your own writing style.Examples structures:I - R - A - C (one legal issue and legal rule)I - R - A - R - A - C (one issue, two legal rules, conclusion)I - S1 - R - A - C - S2 - R - A - C - C (two sub issues)I - R - R - A - C (two legal rules applied together)

  • You do not need to state the full names of cases or legislation. For cases, you can simply refer to the main part of the case name containing the name: e.g. Donoghue v Stevenson. For legislation, you can simply refer to the name of the legislation the first time you refer to it and an abbreviation of the legislation every time you to it thereafter: e.g. Civil Liability Act, CLA. Please underline the names of any cases or legislation in your answers.

  • The exam is an open book exam, meaning that you can have your notes or other material next to you while doing the exam. The exam does not require you to refer to lots of legal rules or any obscure legal rules (we have only based the questions on the main legal rules for the specific topics). For this reason, we strongly recommend that you spend your time doing practice problem questions, rather than spending tons of time writing detailed notes.

  • To do well on the exam, you should aim to answer the questions directly, concisely and clearly. We strongly recommendplanning out your responses before writing them. A clear and well structured answer will always do much better than a longer answer that is unstructured and unclear. We also strongly recommend answering the questions directly, do not waste time writing introductions or other paragraphs that do not go towards answering the questions, rather ensure that all your time is spent directly answering the question.

  • The exam does not require you to refer to any specific number of legal rules (cases or legislation). You only need to refer to the legal rules which are necessary to answer the question. Stating legal rules which do not relate to the question simply in an attempt to state more legal rules will not improve your answer.
