Darko is a computer programmer and is employed by a software development company known as SofTribe Ltd. A retail organization known as Kunte Trading Ltd asked SofTribe to write some computer software to handle Kunte’s accounts and paid SofTribe a fee of GH¢87,500 for the work. All the work was carried out by Darko at Kunte’s premises and on Kunte’s computer during a period of 10 months. Darko was paid an hourly rate (GH¢17.25 per hour) by SofTribe for his work on the project. There is nothing in writing to say who owns the copyright subsisting in the computer software and no assignment of copyright. There is no express or implied agreement between Darko and SofTribe as to copyright ownership. Discuss the position as regards ownership of copyright of the computer program.
