Roe vs Wade (Supreme Court Case)

Roe was a woman who challenged Texas criminal abortion laws stating that abortion should not be allowed just for medical reasons (The Guardian, 2004). It is also a fundamental right for her as a woman. As per the fourteenth Amendment in Due Process Clause as per right to privacy, it should be woman’s choice to keep pregnancy or not. During the course it was recognized by the court that right to abortion is implicit and need to be balanced with legitimate interests so that abortions can be regulated. So women’s right to abortion is not absolute. Due weightage to ‘potentiality of human life’ and the course of pregnancy will be given while deciding on such cases.
