We have discussed many current matters that relate to the Rule of Law and various other legal principles, for example legislation introduced by Premier Doug Ford to combat Covid-19, the SNC Lavalin and WE Charity scandals with Prime Minister Trudeau’s office, and the anti-maskers’ position against the mandatory mask legislation. We also have discussed various actions taken by President Trump. This list is not exhaustive.
The assignment is to discuss, explore, consider and compare the constitutional and legal issues pertaining to two current matters. It is as an opportunity to provide your own unique perspective on these matters, paying specific attention to the similarities and differences between the legal issues pertaining to the matters.
The assignment is to compare the issues not write about them separately.
The assignment should include the following:
- an outline of the pertinent sections of the controversial bill, legislation or proposal;
- an outline of any pertinent sections of the Charter of Rights and Freedoms;
- an outline of any pertinent court decisions pertaining to the matters and the judicial reasons for the decisions;
- consideration and exploration of the issues pertaining to and definitions of 2 or 3 of the following: the Rule of Law, justice, democracy, respect for voters, parents, citizens, as well as parliamentary powers, autonomy of municipalities, the Constitution and the Charter; and
- your informed opinion on whether justice and democracy are being served by the litigation and public discourse regardless of the outcome.
In the event that a final decision on any or all of these issues prior to your completion of the assignment has been rendered, you are expected to reference the decision and provide your reasoned and thought out opinion on it.
You are not required to set out or analyze the process of making a bill into law.
You are not being held to the standard of a veteran politician, seasoned lawyer or constitutional law expert. You will be held to the standard of a first year paralegal student who has conducted the research required to provide thoughtful consideration and make well reasoned arguments pertinent to the relevant issues.
Grades are based on the quality of the assignment, the organization of the elements of the assignment and thoroughness of the analysis of the legal issues.
Proper grammar, sentence structure, spelling, punctuation, and paragraph breakdown are required.
Headings and subheadings are strongly recommended.
Footnotes/endnotes are required if you use any sources, including the textbooks and newspaper articles. You will not be graded on the format of the footnotes/endnotes but they must be included as all sources must be properly referenced.
Case law and legislation must be properly referenced and footnoted.
A reference page/bibliography is required.
The assignment must be 4 - 5 pages in length, typed, 12 font, double spaced and the pages are to be numbered. The page length does not include a cover or title page, or the reference page/bibliography.
