The purpose of this Project is to provide you with an opportunity to demonstrate your knowledge and skills in managing legal and ethical compliance in your chosen industry. 2. Your Project will be performed by completing the following tasks: Select an organisation in an industry of your choice. a. Research one area of legal or ethical responsibility which features in your chosen industry (e.g., confidentiality, complaints, equity and access, discrimination, effectiveness of service, consideration for client needs). b. Create a policy and procedure for the area identified above, using an industry standard template or create your own (Appendix 1 and 2 are samples of policy structure). i. Describe: what the legal or ethical responsibility is and its purpose in your chosen industry ii. Research what laws, regulatory bodies, statutory requirements or policies regulate it iii. Describe which employees in the organisation might be responsible for maintaining this area iv. Describe examples of potential breaches in this area v. Describe how you would review an organisation’s compliance with this legal or ethical responsibility. vi. Describe how you would address non-compliance, and have it rectified. vii. Describe how you would implement this policy and ensure all staff know how to use it. viii. Describe any insurances / licences / accreditations staff / organisation must hold to ensure compliance in this area. Try to choose a different legal or ethical responsibility from your classmates. Definitions Discrimination occurs when someone is treated less favourably than another in similar circumstances because of a personal attribute that has no relevance to the situation. Equity allows all employees to be treated fairly and without discrimination. Sexual harassment is any form of unwanted, unwelcome or uninvited sexual behaviour that is offensive, humiliating or embarrassing. Workplace harassment is repeated behaviour, other than behaviour amounting to sexual harassment, of one employee or group of employees that is unwelcome, unsolicited, and considered to be offensive, intimidating, humiliating or threatening by another employee. Procedure Equity and anti-discrimination philosophy • The organisation strives to provide a positive working environment in which all employees are valued and encouraged to contribute. • As an equal opportunity employer, the organisation is bound by all relevant State and Federal legislation in relation to equal employment opportunity (EEO). CHCLEG003_Written Assessment_Project_4 May 2021 Page 9 of 10 Inclusive language • When writing internal or external documents, ensure that non-sexist and non-racist language is used by: o avoiding male-dominated terms (e.g. use ‘chair’ or ‘chairperson’ instead of ‘chairman’) o eliminating the unnecessary use of the person’s gender (e.g. ‘female Manager’) o avoiding the use of ‘he’ or ‘she’ (use ‘their’ instead of ‘his’ or ‘her’). Breaches of EEO • All breaches of EEO will be taken seriously. • Complaints will be dealt with promptly and in accordance with relevant State and Federal legislation. • All complaints will remain confidential. Employees who feel that they are victims of discrimination or harassment: • Approach the Manager to discuss appropriate actions or options. • Lodge a formal complaint or grievance which will be dealt with by the Manager. For example, a health and safety policy might have a statement to the effect that the organisation will provide workers with a safe work environment. Definitions-if technical language, acronyms, or other language is used that might cause confusion or not be readily understood it can be explained in the definitions section. Objectives-policies should have an objective, explaining the reason for the policy. For example, a health and safety policy might have the objective of reducing the amount of time lost through workplace accidents or illness. Strategies-each objective should have strategies to reach objectives. For example, a health and safety policy might include strategies such as hazard identification, establishing a health and safety committee, training workers before commencing hazardous tasks, providing protective equipment and so on. Specific actions-in addition to strategies, the policy can include specifics such as undertaking hazard identification on an annual basis, developing safe work instructions for all work tasks, training a specific number of employees in first aid, and so on. Outcomes-just as each objective is supported by strategies, each action is supported by outcomes. For example, first aid training might have an outcome that each work area has at least one first aid person available at all times.
