Brittany is an 18-year-old individual with a hearing impairment whose parents have
been disputing during the past three years whether the school has been providing an
appropriate education. Brittany is bright and has earned a C average in spite of not
receiving appropriate programming. She has done well enough to pass the graduation
competency tests. The school now concedes that it did not provide entirely appropriate
programming over the past three or four years, but the programming was not grossly
inadequate. Now that Brittany has qualified for graduation, the school claims that if she
accepts the diploma, she is no longer eligible for public education. Should Brittany be
