Samsung is a South Korean conglomerate formed in 1938 by Mr. Lee Byung Chul. Samsung serves around the world in areas of electronic gadgets, electronic equipment related to business and consumer, IT solutions, healthcare, retail, construction, advertisement, etc. Samsung has over 3.20 lakhs employees from its worldwide business operations (Smith, 2017). With big, This report will concentrate on Samsung Electronics related lawsuits against infringement of patents.
CASE DETAILS
The most vital business for Samsung is its electronic division concerning cell phones. Cell phones have become an integral part of today's lives and a life without a cell phone is hard to find. It was a Nokia which dominated the market space from late 1990 to the early 2000s with its cell phones. However, it was Samsung which made cell phones affordable to every section of people. From then on it has been the market leader across various geographies for Cell Phones. Nevertheless, this success has invited various issues and challenges. Of all the lawsuits it is facing today, the paramount suit is against infringement of patent rights.
The following are the most recent cases filed against Samsung by its competitors, research organization, etc for infringement of patent:
· With Huawei over patent issues for LTE today the world is moving towards 5G and one of the most critical technologies required for 5G is LTE. Huawei sued to state that Samsung has used 11 of its products and technology solutions in its 7 models including Galaxy in LTE technology (Gil, 2016).
· Streaming of media content from Cell Phones to TVs with MV3. Though this isn't a direct lawsuit, however, Samsung issued since its devices are used for illegal streaming. – The content used to stream from the internet belongs to MV3, however, without a contract, the content on the devices are allowed to stream on the Television (Jie & Hasan, 2017).
· With Parus against the use of voice assistants for browsing on the internet or receiving other help. – The patents for voice assistance on any electronic device are owned by Parus. Though Samsung uses voice recognizing technology in its premium devices, it has failed to enter into a legal contract to use the same(Chen, Ni, Liu & Teng, 2015).
· With IXI Mobile for infringement related to claim of a hotspot – hotspot technology is the use of Wi-Fi either in phones or laptops through hotspot technology. This case is a tricky one since earlier US court had dismissed the initial lawsuit filed by IXI Mobiles stating lack of evidence. But IXI Mobiles has been filing lawsuits in various jurisdictions (Smith, 2017).
Though the cases mentioned above come from different periods and petitioners, however, all of them come under the umbrella of Patent Infringement. As of October 2019, there are 380 lawsuits filed against Samsung for infringement of patents worldwide.
