“Quality Assurance” referenced in FAR Part 46 recommends guidelines to ensure that supplies and services acquired under Government contract conform to the contract’s quality and quantity requirements”.   1. Review Section 46.703 of the FAR and determine the criteria for invoking use of the “ Warranty” provision if there is a defect, fraud, or gross mistakes in the goods or services provided.

  2. Review Chapter 18 of the “Government Contract Guidebook” and determine whether “express warranty” or “implied warranty” offers the government better protection against defective services.

Initially the government should prove existence of the defect in warranted system. Burden of
the government for proving the defect can be unnecessarily complicated when this need to
identify defect among the specific goods & services warranty.
Where the contractor has been responsible to deliver the product, government must
not have to bear burden about isolating as well as proving the defect in goods & services.
This must be sufficient that delivered system has been demonstrably defective; this has been
then up to contractor for finding as well as fixing the defects.
Additionally, the defects for the purposes of the system warranty coverage must be
defined in regard to the goods & the services performance needs (Contractor Inspection
Requirements (Apr 1984), Not defined). Coverage for the goods & the services performance
