Are third-party consents to search the defendant’s premises valid in the following circumstances?
a. A husband, out of anger at his wife, the defendant, invites the police into the house and points out evidence incriminating the wife. b. The defendant’s girlfriend, who lives with him part-time, consents to a search of the defendant’s apartment. c. A wife disobeys the instructions of her husband, the defendant, not to allow a search of their home. Does it matter whether the police know of the instructions? Does it matter whether the husband is present at the time of the search?
