  • Problem:


    Mr. H. was a diabetic and had severe ulcers on his feet. He was a member of an HMO, and his primary care physician had prescribed a treatment regimen that was proving ineffective. In response, the primary care physician offered Mr. H. an amputation below the knee that was his only option. Mr. H. went out of plan to a local wound care center that specialized in diabetic wound treatment where he was advised that vein by-pass surgery would likely take care of his problem. The HMO denied such surgery because Mr. H. referred himself to the specialist without permission. The HMO advised Mr. H.'s family that its utilization review department was reviewing the case, but that it would take at least a month to review. Subsequently, the HMO agreed to approve such surgery, but only if done by Mr. H.'s current medical group, which did not have any physician who had ever performed vein by-pass surgery. Mr. H.'s family asked for him to be transferred to a primary care physician at the medical group that staffs the wound care center. The HMO responded that although they sometimes approve such requests, they would not do so in Mr. H.'s case and that they had already granted enough of his requests. They gave as their reason a provision in the plan documents that prevent referrals outside the plan's network when the network's physicians have the capability to perform the required procedure

Mr. H. was a patient of diabetes and severe ulcers of the feet and member of a health
maintenance organization (HMO). He is a member of an HMO that means it has health insurance
and he
alth care benefit plan. He has required vein by-pass surgery treatment for its health
problem and HMO agreed to approve such surgery, but only in the case of it has done by Mr.
H.'s current medical group. Mr. H.'s family requested for the HMO to be transferred his surgery
to a primary care physician at the medical group of wound care center but the HMO has not
given approval for his family request. HMO gave reason of it that the network's physicians have
the capable of doing the vein bypass surgery of Mr. H. Under federal law, a patient has right of
procedure remedies to protect its life, prevent its health for significant illness, significant
disability and alleviate severe pain (Mitchell, Mitchell & Haroun, 2011).
According to case problem, Mr. H wished to a vein bypass surgery of his problem. The
HMO has not given approval of amputation and given reason that Mr. H had already enough
requests approved and is has not seem reasonable reason that has been given by him. Under
private insurance, patient does take procedure remedies for normal disease not for critical disease
(Umphred, Roller, Burton & Lazaro, 2012). Under private insurance, the insurance company can
pay hospital deductibility and 20% portion of this amount has not paid by private insurance
companies.
At the same time, private insurance company has not paid off post-hospital nursing
facility, home health care of patients and outpatient charges of the customer. Diabetes is a type of
critical diseases, so under private insurance Mr. H could not likely have procedure remedies
(Fordney, French & Follis, 2007). This is a type of long-term disease or problem, so private

companies has not provide claim of these types of disease that does not provide procedural
remedies option of the patient.
Medicare and Medicaid set up by the federal government and administered differently in
each state to provide health insurance for almost everyone Americans aged 65 or older.
Furthermore, Medicare assures almost everyone people while the Medicaid covers low-income
and financial need people (Laxminarayan & Malani, 2007). Medicare affords basic coverage for
hospital stays and post-hospital nursing facility and home health care of patients that given
rationale that Mr. H under the Medicare procedural remedies option has available.
In addition, Medicaid provides compensation of inpatient and outpatient including many
services and costs that also provide evidence that under the Medicaid Mr. H. has used the option
