An inmate developed a long-standing homosexual relationship with his cellmate, but his partner was transferred to another institution. State regulations prohibit correspondence between inmates, so they are not able to write to each other. They are planning to sue the state, citing discrimination on the basis of sexual orientation, since married heterosexual couples serving time at different facilities are able to correspond with each other. Use the decision-making standards on page 437 to determine whether or not the state’s position is likely to be upheld. Then look up the decision in Turner v. Safley (482 U.S. 78, 1987) to see how the Supreme Court ruled in a similar case.
