1.) The NYT article talks a lot about the decision in McKleskeyv. Kemp. What happened in that case that led to
certain justices being regretful in that ruling? How has this case impacted justice today?
The case of McCleskey who was a black man and got convicted of a police officer’s murder in Georgia and was given death sentence was a crucial case of 1987. This case shows that death penalty imposition in Georgia depends majorly in the victim’s race and accused. The study shows black defendants killing white victims are more prone to be given death sentences. In this case, the 5-4 decision by the majority opinion made certain justices being regretful because the racial discrimination played its role in the case. The decision of Supreme Court protected criminal justices policies as well as laws from being challenged on basis of racially disparate impact. This case impacted the justice in today’s era because this decision set the stage of dramatic upsurge in racial disparities for more than 20 years within the criminal justice system. At that time, court ruled that even race discrimination’s solid stat evidence didn’t offend constitution.
