1. Introduction
1.1 Background
The LGBTI is usually referred to the Lesbian, Gay, Bisexual, and Transgender persons or people in this world. Further, LGBTI has been also recognized and adopted by the most of the sexuality and gender identity-grounded community in most of the countries at the global level. The LGBTI that is based on the cultures of a diversity of sexuality and the gender identity usually denoted as non-heterosexual also in several countries, such as The USA, UK, etc (Shankle, 2013). The LGBTI community is generally united through a common culture at the global level that make them very different compared to the common people based on behavior and civil rights.
The LGBTI community in this world generally represent themselves as a social component and believed to get equality in civil rights. However, they get less value in the society than the common people because of non-heterosexual allies. In order to get equal rights in this world, they have developed several LGBTI organisations in their current struggle to make themselves globalised recognition. In this consideration, the LGBTI community of Nepal is very complex in terms of advocacy. The case report of LGBTI people in Nepal is related to the legal and social environment (Shankle, 2013). At the same time, the LGBTI rights in the Nepal country in the context of human rights and laws, as well as the legal environment are very different than the other countries of the world. There is also matter for the LGBTI community in Nepal associated with the socio-cultural environment and religion.
In order to improve their life in Nepal, most of the activists are specifically fighting for the education, and employment, as well as family affairs. The matter of health, and media, including the political affairs has become essential to provide them to increase their capacity of LGBTI organizations. In the historical point of view in Nepal, the diverse genders and sexualities of the individuals was recognized as ancient religious texts that increase number of tolerance related to the LGBTI people (Shankle, 2013). The importance of religions in Nepal can be seen as Hinduism and Buddhism in most of the circumstances that are almost 95 percent of the total population. The violence could be seen related to the religious extremism in Nepal.
However, in the context of gender segregation in the society of Nepal can be seen as making friendship and men can make physical contact for the sexual activity. On the other side, Nepal government does not allow for the sexual orientation or gender identity in any circumstance. In last 20 years of Nepal, the LGBTI community has achieved recognition in the field of political environment as human rights promotion provided by the Supreme Court (Wimmer & Dominick, 2010). The laws can be assumed for the LGBTI people as anti-discrimination and same-sex marriage in critical manner.
In most of the circumstances in Nepal, the advantages in political environment cannot be seen provided by the political parties for the LGBTI community into the daily lives. There are discrimination and violence with the LGBTI individuals in the society regarding employment, and health care, as well as for education to receive. The bureaucracy avoids implementing strong policies and laws for the improvement of the LGBTI life (Wimmer & Dominick, 2010). There is another face of the life of LGBTI people in Nepal that can be recognized as extreme poverty. Apart from this, the lack of priority of human rights of LGBTI people is a major issue in this country.
Because of the lack of human rights in Nepal for the LGBTI community or people, the basic needs cannot be fulfilled effectively and efficiently. There is enough food for the LGBTI individuals with adequate shelter provided by the United Nations and other NGOs; but, difficulties in getting equal human rights for LGBTI person keep them in crushing poverty (Wimmer & Dominick, 2010). The living environment of the LGBTI people in Nepal is very critical because of diverse society that is divided into different castes, and ethnicities, as well as social classes. The problems of the LGBTI society individually are settled based on age, gender, and sexual orientation.
The issues with the LGBTI individuals have also been marked as obliged to hide their sexual orientation in Nepal. This is usually identified as subject to human rights violations, and discrimination, as well as stain. On paper, the life of the LGBTI people is advanced; but the actual condition or lives is challenging critically. This has caused due to widespread poverty and rigid social norms. Additionally, the lacking interest of bureaucracy of Nepal and an unsympathetic legal framework have also contributed to make a worse position of the LGBTI people in this country (Wimmer & Dominick, 2010). It is considered that the high level public advocacy can improve the life of LGBTI community when policy and legislative reforms are developed specially for them. This can ensure to provide LGBTI rights according to the issues when prominently highlighted in media.
1.2 Purpose
The main purpose of this paper is to analyse legal and social environment of LGBTI individuals and civil society of Nepal. The purpose of this paper is also related to explore how to protect the rights of LGBTI people in Nepal to improve their living conditions and equalize the human rights for them.
