1. What do state education statutes relating to special education add to the IDEA? Why doesn’t the IDEA cover these issues?

2. In Owasso, the Court found that the practice of peer grading of papers did not violate

FERPA—at least, when it was done in the manner at issue in the case. Are there

circumstances where peer grading may violate FERPA? What about allowing students

without disabilities to assist students with disabilities in school? Consider the following

example:

The elementary school has a “Writing Buddies” program wherein fifth grade students help third and fourth grade students with learning disabilities. The fifth grade students model how to write a certain passage from a topic question and then help the third and fourth grade students complete the same task by working with them directly as the student writes out the passage in response to the topic question. The fifth grade student then reviews the student’s written work and gives the third or fourth grade student some feedback on how to improve it and assigns it a number grade from 1 to 10. The written work then becomes part of the student’s writing portfolio that is part of the student’s overall writing grade.

Would any part of this activity violate FERPA?
